All Packages are shipped by Federal Express Someone must always sign for the package when delivered and destination of a package cannot be changed once it has left our location. Orders placed after 2PM Pacific time will be processed the next business day. We cannot ship to PO boxes or hotel rooms.

A1A Computing, Inc. requires your full name, billing address, and a valid picture identification for any purchase made with a credit card, any type of check and on all open account orders. Cash transactions under $10,000.00 do not require the above information, but such information may be requested for our internal purposes in order to keep you informed of any upcoming specials and promotions. We reserve the right to refuse acceptance of payment by check of any type.

DELIVERY

All shipments are f.o.b. Seller and the cost of shipment is in addition to the purchase price payable on items sold hereunder. Risk of damage or loss is the customer's responsibility after delivery by A1A Computing, Inc. to a carrier for shipment. Estimates of shipping dates are approximate, representing A1A Computing, Inc's best judgment when made. A1A Computing, Inc. shall not be liable for any delays in shipping or in the amount of time in which it takes shipment to reach customer. On returns to our facility, no credit will be allowed for items damaged in transit or shipped to us in error.

WARRANTIES

All MEMORY comes with a limited LIFETIME warranty from A1A Computing, Inc. All other warranties are from their respective manufacturers. Defective items must be returned to the manufacturer for warranty purposes. A facilitation charge may apply to products being sent back to the manufacturer by A1A Computing, Inc. for the customer, including all shipping costs. Customer is responsible for non-warranty repair costs and any shipping charges. Software issues are not covered under any warranty. All new hard drives have only a manufacturers warranty. Defective Apple products will be repaired only. Used desktop computers come with a 90-day warranty, including parts and labor, not software. Used laptops come with a 30-day warranty, including parts and labor, not software. If warranty is not specified, the item has been sold on an “AS IS” basis with no warranty, expressed or implied. Merchandise that carries a A1A Computing, Inc. warranty may only be serviced or repaired by A1A Computing, Inc. All repairs come with a 90-day repair warranty from initial date of service; however, no repair service shall extend any other warranty. Any merchandise opened by any dealer or individual, other than A1A Computing, Inc. is no longer covered by warranty. A1A Computing, Inc. will strictly enforce cancellation of warranty rights for removal of any warning sticker stating either “Warranty void if removed,” “warranty void if label is removed or tampered with”, or any white identification sticker placed on merchandise by A1A Computing, Inc. A1A Computing, Inc. is not responsible for any loss of data, time, business or anticipatory profits, or special or consequential damages by accepting any item (either under warranty or out of warranty) for repair. No other warranties are made, expressed or implied, other than those expressly stated herein. Not responsible for manufacturers warranties. Not responsible for typographical errors or omissions. All warranties will be deemed void for customer negligence or product misuse. All warranties are non-transferable. Software problems are never covered under any warranty. Warranties are not applicable for sales to dealers, consultants, and resellers.

APPLE WARRANTIES

All new Apple computers come with a limited one-year Apple warranty. A1A Computing Inc. is an NOT an Apple Authorized Service Provider. Open boxes on Apple products are non-returnable, but qualify for expedited service if defective. All Apple warranty work is covered by a 90-day warranty from Apple. Apple service parts may be refurbished. Defective Apple products will be repaired only by an Authorized Apple Dealer. Please see Apple.com for further terms and conditions.

RETURNS

Returns will only be accepted on new unopened products at A1A Computing Inc.'s discretion. Due to the time value of the merchandise sold by A1A Computing, Inc., we can only consider claims on products returned to us within THREE (3) days, exclusive of transit time, from the date of the invoice. Memory comes with a 3 day no questions asked return policy (abused or damaged memory products will not qualify. Not applicable to special order memory and/or other products.) Open boxes on Apple products are non-returnable. An original invoice must accompany all returns. A returned merchandise authorization number (RMA) issued by A1A Computing, Inc. must accompany all returned goods. The RMA number must appear on the outside of the package or the package will be refused. A1A Computing, Inc. reserves the option to refund, credit or replace parts returned. All returns are subject to A1A Computing, Inc.'s approval. A1A Computing, Inc. reserves the right to refuse returns. All returns are subject to a minimum 20% restocking fee. If merchandise is returned in non-working condition, the 20% restocking fee is still applicable. Non-working merchandise will be replaced or repaired at A1A Computing, Inc.'s discretion. No returns will be accepted on Special Order items. Items sold as new must be returned in original new condition with original packaging, unopened, no exceptions. All shipping costs are the customer's responsibility.

MAILING LIST

A1A Computing, Inc. reserves the right to disclose to third parties the names and addresses of customers who purchase products from A1A Computing, Inc. only to help promote A1A Computing, Inc. and deliver specials to our customers. We may also disclose the subject matter of the items purchased for the purpose of marketing goods and services directly to the customer. By purchasing an item at A1A Computing, Inc., customer consents to the foregoing. (Our customer list is not for sale.)

FINANCING

A1A Computing, Inc. reserves the right to decline to make deliveries (except for cash) whenever A1A Computing, Inc., in its sole discretion, determines that customer may not be financially responsible, and A1A Computing, Inc. shall have no liability to customer in such event. A finance charge will be added to all past due accounts at the rate of 1.5% per month.

TAXES

Customer agrees to pay all taxes, however designated, levied, or based on the sales price, or payable by A1A Computing, Inc. in respect thereto. Taxes and duties collected by shipper are payable by customer if sold by A1A Computing, Inc.

SECURITY INTEREST

A1A Computing, Inc. reserves and customer grants a security interest in all items sold hereunder (and proceeds thereof) as security for the payment by customer of the full purchase price of such items. Customer agrees to execute all documents necessary to perfect A1A Computing, Inc.'s security interest therein. Customer accepts liability that if Apple products are resold that they are responsible for any and all damages coincidental or otherwise directed at A1A Computing, Inc. Customer has agreed not to resell Apple products.

PATENTS, ETC.

A1A Computing, Inc. assumes no obligations or liability with respect to infringement of United States or foreign patents, copyrights, trademarks, or other proprietary rights arising out of any items hereunder.

JURISDICTION/VENUE

If an action is commenced to enforce the parties' rights as herein stated, customer consents to the exercise of the exclusive jurisdiction of the state courts of the State of California, County of Los Angeles, with exclusive venue in the City of Santa Monica.

LIMITATION OF LIABILITY

Notwithstanding anything to contrary contained herein or elsewhere, A1A Computing, Inc.'s responsibility for losses or liabilities arising out of or related to this contract for the items covered hereunder shall not exceed the purchase price as reflected on the invoice. In no event shall A1A Computing, Inc. be liable for special, indirect, incidental or consequential damages of any kind, whether suffered by customer or a third party. In no event shall A1A Computing, Inc. be liable for any loss of use, revenue, profit, custom, direct, indirect or consequential damages arising out of, connected with or resulting from the sale of goods hereunder.

ATTORNEY'S FEES

In the event any action or proceeding is commenced to interpret or enforce the terms of/or obligations arising out of this invoice, or to recover damages for the breach hereof, the party prevailing in any such action or proceeding shall be entitled, in addition to any other relief demanded, to recover from the other party all reasonable legal fees, costs and expenses incurred by the prevailing party. In addition, the prevailing party shall be entitled to recover from the non-prevailing party judgment attorney's fees incurred by the prevailing party in enforcing a judgment award or breach of this invoice. TO THE EXTENT ALLOWED BY LAW, ALL PARTIES HERETO WAIVE ANY RIGHTS THEY MAY HAVE TO A TRIAL BY JURY.

ENTIRE AGREEMENT

This invoice sets forth the entire agreement and understanding between the parties and supercedes all prior agreements and understandings between them with respect to the subject matter of this invoice. Any modification to this invoice must be in writing and reference this invoice.
